Malicious Evaluation and Career Devastation

C. Lee Odell (with Neel and Swiney)

Case studies address repugnant moral and ethical behavior experienced in US universities
during many years as a corporate CEO and professor.

Richard S. Neel (University of Washington - UW), C. Lee Odell (Rensselaer Polytechnic Institute - RPI), and John F. Swiney (Central Washington University - CWU) tried to justify their mutual denial of equal opportunity and human rights by conspiring to destroy credentials despite repeated verification of them by other universities and agencies approved by US Department of Education. A thorough investigation by an attorney appointed by American Civil Liberties Union (ACLU) verified those documents and recommended civil and human rights action against University of Washington which an ACLU committee approved. In three almost identical confrontations, two of them three thousand miles apart, the antagonists acted out similar demeaning theatrical fantasies. Choreographed rage or tantrums frequently demonstrate the limit of emotion sociopaths can experience. They mimic each other then act out mutual fantasies to mask their own dysfunction in a manner that emulates mimicry used by stage actors. In the case of Neel, Odell, and Swiney the alleged crimes predicated upon mutual mimicry which provided concealment and protection from punishment for alleged criminal activity.








Neel


Richard S. Neel, University of Washington

The term "sociopath" (formerly psychopath) describes the DSM-IV clinical term "antisocial personality disorder" which defines aggressive, impulsive, antisocial behavior. Approximately 3% of men and 1% of women suffer from this disorder. Neel, Odell, and Swiney classify as sociopaths based upon their recorded performance as administrators in different universities.

Sociopaths often encounter legal difficulties due to their disregard for societal standards and the rights of others which often includes criminal activity. They do not appear to experience a full range of human emotions which explains the lack of empathy and disregard for the suffering they cause to others.

Sociopaths remain indifferent to the possibility of physical pain or punishment because they think that they occupy positions of unimpeachable power. They show no indication that they experience fear when threatened; this may explain their apparent disregard for the consequences of their actions and lack of empathy when others suffer their abuse. Swiney exemplifies this sociopathic behavior. Would a rational person deliberately move back to a state where he allegedly committed serious crimes and ignore outstanding criminal complaints in that jurisdiction? [Ravening Sociopath]

Swiney allegedly committed crimes at University of Washington then moved out-of-state to California State University - Chico. He has now moved to Central Washington University in the same jurisdiction and governed by the same laws under which he allegedly committed those crimes.

Harassment Strategies

Neel and Odell used identical humiliation tactics. They made appointments for 30-minute sessions then waited beyond the appointed time with their doors left ajar so that the interviewee could see them and hear the trivia they were discussing on the telephone. After more than thirty minutes they waived him in saying that they could only stay a few minutes then spent that time making humiliating comments. John F. Swiney used similar abasement tactics to support them.

At Rensselaer, Odell said: "I am not interested in anything you do or say" and at University of Washington, Neel said: "you must jump through my hoops" as though the author ranked as a circus animal with him as the ringmaster. Neel insolently used a secretary as a go-between while only twenty feet away.

Odell then set up harassment strategies with other department professors which, after sixteen months of harassment, caused the author to write this letter:

Arbitrary and Capricious Evaluation

At our advisory meeting during the spring of 1986 you stated that two of the professors with whom I had taken courses during the fall of 1985 had informed you that I “was lacking the ability to articulate my understanding of the concepts described in the readings for the courses.”

You reiterated that statement at our meeting on October 30, 1986 and again criticized my academic performance. You neglected to be specific and did not allow me to interject my thoughts and feelings, to refute your statements that I had incurred an incomplete grade, or to reference a previously lodged formal complaint.

Although I explained to you that no professor had discussed with me any lack of ability, you have entered an uncorroborated and irrevocably damaging statement into my personal file. This statement reflects not only upon my competence as a doctoral candidate but also upon my standing as a university professor with many years of experience in technical communication and an unblemished teaching record. In all probability your opinion has been used to deny me employment and discriminates against me in the award of financial aid.

I construe your actions to be prejudicial infractions of university policy and other regulations which include, but are not limited to: performance not evaluated solely on an academic basis; prejudiced and capricious evaluation; unfair judgments of ability with regard to equal employment opportunity.

Please furnish to me:

1. The names of the professors whom you quoted.

2. The titles of the courses to which you alluded. It is my right and responsibility to verify these statements and ascertain the basis for the alleged probation.

Odell never responded; instead, he conspired with S. Michael Halloran and Gary Judd in an arbitrarily and malicious credential challenge to deny registration for the fall semester then colluded with Neel to deny registration at UW.

Neel used the same fraudulent procedure that Halloran and Judd had followed when they released only part of a curriculum vitae and a few documents for evaluation to insure a negative response. Neel silently and arbitrarily cancelled a previously approved registration claiming lack of qualifications for doctoral work. [Theater of the Absurd]

Neel ignored the fact that James I. Doi, a previous dean, had approved those same credentials. He then passed false and misleading credential information to a novice admissions administrator, John F. Swiney, who knowingly provided a negative evaluation that supported Neel’s unlawful actions.

John F. Swiney, Central Washington University

At a meeting with the author, Swiney said without interrogation or discussion: "your total education equates to what you would have gained from one year at a community college" . . . " you will have to earn an undergraduate degree first and then pass the graduate record examination". He used identical humiliation tactics to those previously used by Neel and Odell.

Swiney ignored documents certified by International Education Research Foundation (IERF), a credential evaluation service accredited by US Department of Education which included: a Rensselaer masters degree; UK MSc and BSc equivalencies; and, completion of all course work for a PhD at Rensselaer. The author previously held positions as a tenure-track assistant and associate professor also as a university administrator at several other universities.

Prior to Swiney's evaluation, Institute of Printing (IOP now 3P) elected the author a Fellow after forty years as a full member and International Society for Typographic Design (ISTD) elected him a Fellow following personal sponsorship by three former ISTD presidents based in NY/Berlin/London for excellence as an international typographic designer. Moreover, IEEE appointed him Associate Editor for Graphic and Visual Communication, PCS/IEEE.

Fitchburg State College appointed him assistant professor, RPI appointed him adjunct faculty member, San Jose State University appointed him associate professor, and a department chair offered him a faculty position at UW - Swiney’s own university. Any rational person would determine that those accomplishments rank a little more than Swiney's evaluation: "your total education equates to what you would have gained from one year at a community college". Swiney, a state employee, maliciously made a biased and politically expedient decision not based upon the facts. By that, he allegedly committed gross misdemeanors under Washington state laws.

Swiney also tried to pervert the course of justice by fabricating or interfering with evidence and threatening or intimidating a witness which classifies as a criminal offense punishable by a jail sentence.

The malfeasance has left the author with a $400,000 debt and losses in excess of $4 million. The author expended the current equivalent of $100,000 in the initial three years on tuition and legal fees at RPI for which he received absolutely nothing. With additional tuition at UW, the outstanding debt has now accumulated interest and penalties amounting to about $400,000. That amount increases each year that both universities continue to deny due process of law. Blackballing and blacklisting mainly by Halloran, Odell, and Whitburn (RPI) over two decades and the joint RPI/UW experience cost in excess of $4 million.

Debt collectors continue to pursue payment by using unlawful harassment. They also pester friends and acquaintances despite both Shirley Ann Jackson (RPI) and Mark A. Emmert, presidents of RPI and UW respectively having received legal notices to cease and desist about three years ago. Moreover, UW uses the debt as an excuse to withhold records and transcripts. Administrators at both universities continued to march in lockstep to cover up the initial fraud at RPI. In so doing, they allegedly committed myriad crimes and invalidated personal integrity.

Swiney left University of Washington (where he received $69,408/pa) to become Director of Admissions and Records, California State University, Chico. He became a big fish in a small pool instead of a pollywog in the UW cesspool that he helped to create. He has now moved to Central Washington University (CWU) as associate vice president for enrollment management. CWU announced that Swiney will: “. . . work in concert with the members of the summit team on completing and implementing the plan. Once the plan is fully developed, it will be made available to the entire campus community” - whatever that nebulous description means.

Neel, Odell, and Swiney exemplified the humiliating behavior frequently used by university administrators who had not been anywhere very much or done anything significant. They jointly and severally attacked and defamed a professor many years their senior with both industry and academic experience far in excess of their own. Or, in newsroom vernacular that the next generation will understand, a trio of sick bastards that groveled before perceived authority for self-aggrandizement and career advancement now depend upon a wall of political silence to evade prosecution.

Contra Cabal Foundation

Contra Cabal web sites have achieved an extraordinary readership. If Paul Trummel dies before he completes his work, then trustees have authority to continue publication as an educational project through the newly formed Contra Cabal Foundation, London which will own all publication rights. The Foundation will publish Contra Cabal in perpetuity in the way that Sonia Orwell posthumously published the collected works of George Orwell.

Foundation trustees and directors (professional people, lawyers, and academicians in UK and US connected directly and indirectly with the International Federation of Journalists) will supervise editorial and design functions using young investigative reporters and graphic designers who wish to further their education in journalism. They will receive trade union freelance rates of payment for their work.

The Foundation will respect former trustee the late William D Winn's last admonition "Go get 'em!" by continuing to report academic malfeasance and to expose morally repugnant academicians and public officials.

Nothing Succeeds like Excess

Academic freedom, an absolute right not an abstract philosophy, should not subserve economic considerations.

Moreover, information technology remains a right not a privilege despite technocratic claims to the contrary.

Legislative and judicial decisions have determined the right of individuals to distribute information freely and the Bill of Rights documents the protection individuals should expect from the state.

However, laws do not provide much protection when despotic administrators interfere with computer resources because they disagree with the content of messages: a disagreement probably based upon disclosure of their own malfeasance.

They fear dissent and have an aversion to controversy. Their addiction to political correctness frequently causes them to invoke censorship of Internet activities.

They not only empower their systems administrators to handle frivolous email complaints by arbitrarily removing computer access but also allow them to censor incoming mail - an outrageous invasion of personal privacy.

They act upon an irrational expectation that certain categories of email may contain something that Big Mama would not wish others to read then arbitrarily reject it.

Interference with email transmission not specifically proscribed by federal law classifies as a federal offense which Rensselaer and University of Washington officials commit with impunity.

Shirley Ann Jackson, the latest arrival in a trio of uncaring Rensselaer presidents: Schmidt (1988), Pipes (1993), Jackson (1999), continued to employ Thomas Phelan, former H&SS Dean, as "university historian" and publicly adulated him at his death (2006), knowing that he had defrauded the university of millions of dollars by posing as a PhD when he did not hold a post-graduate degree.

Phelan's fraud trickled down to negatively affect students. Informed about denial of due process of law to untenured faculty and students, Jackson did nothing about it. She maintains a hypocritical political silence on issues that have had a devastating effect on many faculty and student lives while she unashamedly touts an ethical institution.

Phelan's deanship allowed him to employ a cabal of unqualified and inexperienced faculty that in turn short-changed hundreds of students who had paid one of the highest rates of tuition in the US. RPI breach of contract left them with a huge tuition debt and cost them millions of dollars in income through loss of their careers. Successive deans Duchin (1996) and Harrington (2002) covered up the criminal activity that they inherited which effectively made them accessories after the fact.

2007 has seen publication of a series of articles that expose academic and criminal fraud at Rensselaer and University of Washington (UW). They describe a cover-up of ongoing fraud that Jackson, Palazzo, and Harrington (RPI) also Emmert (UW) have neglected to address.

Paul Trummel, published since 1944, uses the pseudonym Nmesis and openly declares personal or conflicting interests.

These conflicts may relate to topics or to opinion, especially when the content draws upon advocacy, experience, conclusion, or interpretation.

As an accredited journalist, he conforms with the code of conduct and ethics of the journalism profession, tested by courts in both Great Britain and the USA.

Washington Supreme Court unanimously reversed a lower court decision that effectively allowed prior restraint and defined journalism inquiry as surveillance and harassment.

Repeatedly, lawyers who could find no fault with content instead personally attacked the author or his genre.

A corrupt judge imposed prior restraint and jailed him for contempt when he challenged the court decisions as a basic violation of constitutional and human rights.

To further coerce him, in consort with other jurists, the judge then arbitrarily transferred him to solitary confinement among murderers and rapists.

His published work in the print media for more than sixty years has received no challenge relating to accuracy.

People, among them elected judges and lawyers upon whom the public should be able to rely, have tried to stop him publishing information on politically sensitive issues.

That prior restraint, and restrictions on personal mobility, has now become a matter of international concern.
